Hotel Plaza Huatulco Bungalows located at Boulevard Benito Juarez S/N, Lot 23, Tangolunda Hotel Zone, Bahías de Huatulco, Oaxaca, Mexico, ZIP Code 70989, is responsible for the collection and use of your personal data, as well as its protection. In accordance with Articles 8, 15, 16, and 36 of the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP).

Purpose

To ensure the proper, controlled, and lawful use of personal data handled for the administrative system processes at Hotel del Carmen. Your information is required for the hotel's internal processes. The means of obtaining it include registration forms, telephone reservations, quotations, agreements, satisfaction surveys, comments, complaints, and/or suggestions. The requested personal data includes:

  • Full name (First name, Paternal surname, and Maternal surname).
  • Guest's signature.
  • Home phone and mobile phone.
  • Credit or debit card details.
  • E-mail.
  • Place of origin.
  • RFC (Federal Taxpayer Registry).

This information will be used for the following purposes:

  • Guest stay security
  • Reservation creation
  • Issuance of tax receipts
  • Sending promotional information of the company
  • Building a customer database
  • Improvement of control and execution of subsequent service processes
  • Security and safeguarding of personal data

Hotel Plaza Huatulco Bungalows aims for the personal and/or sensitive data, which may be collected under this Privacy Notice, to be used for the proper operation and purposes of the Hotel and for governmental authorities that may require them. This is intended so that the data can be used for administrative, marketing, sales, statistical purposes, and other purposes that may be of interest to and/or benefit the data subject.

The safeguarding of personal data is the responsibility of Hotel Plaza Huatulco Bungalows, which will take the necessary measures to prevent the loss and/or theft of information stored in both physical and digital files. We are committed to not transferring your personal information to third parties without your consent, except for the exceptions provided in Article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties, and to making such transfers in the terms set by that law.

Exceptions to Article 37:

  • When the transfer is necessary for medical prevention or diagnosis, healthcare provision, medical treatment, or healthcare services management;
  • When the transfer is made to controlling companies, subsidiaries, or affiliates under the common control of the responsible party, or to a parent company or any company of the same group of the responsible party operating under the same processes and internal policies;
  • When the transfer is necessary due to a contract concluded or to be concluded in the interest of the data subject, between the responsible party and a third party;
  • Cuando la transferencia sea necesaria o legalmente exigida para la salvaguarda de un interés público, o para la procuración o administración de justicia;
  • When the transfer is necessary or legally required to safeguard a public interest or for the procurement or administration of justice;
  • When the transfer is necessary for maintaining or fulfilling a legal relationship between the responsible party and the data subject.
  • For the exceptions provided in Article 37 of the Federal Law on the Protection of Personal Data, if you do not express your opposition to the transfer of your personal data, it will be understood that you have granted your consent for it.

Explicit indication of treatment of sensitive personal data.

At Hotel Plaza Huatulco Bungalows, in addition to the previously mentioned personal data, we will use the following sensitive personal data for the purposes outlined in this privacy notice: current and future health status, religious, philosophical, and moral beliefs, and union affiliation. We inform you that the processing of these sensitive personal data is intended for Hotel Plaza Huatulco Bungalows to fulfill the obligations arising from the legal relationship we have with the data subject. We are committed to ensuring that these data will be processed under security measures that guarantee their confidentiality.

Means to revoke consent for the processing of personal data.

You may revoke your consent for the processing of your personal data by submitting a request to the Official Privacy Officer, either through a written statement, email, or by phone. If, after the revocation, you request confirmation of it, the Responsible Party will respond to you expressly.

Means to exercise ARCO rights. (ARCO stands for Access, Rectification, Cancellation, and Opposition rights in relation to personal data.).

You have the right to:

  1. Access your personal data in our possession and learn the details of its processing;
  2. Rectify it if it is inaccurate or incomplete;
  3. Cancel it when you believe it is no longer needed for any of the purposes outlined in this privacy notice, if it is being used for non-consented purposes, or if the contractual or service relationship has ended; or
  4. Oppose its processing for specific purposes, as required by law (collectively, the "ARCO Rights").

To exercise your ARCO Rights, you must submit a request (the "ARCO Request") to the Responsible Party, addressed to the Official Privacy Officer, at the Contact Department, along with the following information and documentation:

  • A copy of documents that prove your identity (such as a copy of your voter ID, passport, or any other official identification) or, if applicable, documents that prove your legal representation, with the original presented in order to receive a response from the Responsible Party;
  • A clear and precise description of the personal data regarding which you wish to exercise any of the ARCO Rights;
  • Any document or information that helps locate your personal data; and
  • If you are requesting a rectification of your personal data, you must also indicate the changes to be made and provide documentation that supports your request.
The Privacy Officer will respond to your ARCO Request and the reasons for the decision via email.

Cookies and Web Beacons

It is worth mentioning that when accessing websites, you may encounter "cookies," which are text files that are automatically downloaded and stored on the user's computer's hard drive when browsing a specific webpage. These allow the server to record some of your data.
